Use of the Rainforest Alliance Web site is subject to agreement with the following terms of use.
Copyright
The entire Web site is copyrighted by the Rainforest Alliance. All of the material found on the site is copyrighted by the Rainforest Alliance except that copyrighted by other parties and reproduced with permission. All rights are reserved.
Warranty and Liability
In no event shall the Rainforest Alliance be liable for any loss, claim or damages, whether consequential or incidental, arising either directly or indirectly from use of or failure to use the Web site. In addition, the Rainforest Alliance shall not be liable for any loss, claim or damages, whether consequential or incidental, resulting from any failure or delay in including or updating materials on the site.
The Rainforest Alliance assumes no liability for decisions made or actions taken in reliance upon information found on the Web site.
Some states do not allow the exclusion of implied warranties and/or the limitation or exclusion of liability for incidental and consequential damages, so the above exclusions do not apply to all individuals.
Defective and/or Contaminated Materials
Although the Rainforest Alliance makes every effort to ensure the correctness of information it provides, the Rainforest Alliance disclaims responsibility for any errors or omissions on the Web site.
The Rainforest Alliance cannot and does not guarantee or warrant that all of the files that make up the Web site are free of computer viruses, worms and other material having contaminating or destructive properties.
User Rules
Users may not send, post or transmit any message that is libelous or defamatory, or violates any other person's copyrights, privacy rights, trademarks, trade secrets, etc. Users indemnify the Rainforest Alliance for any and all damages suffered by third parties that result from violations of this term.
Users may not change the facts, tone or meaning when quoting any of the material found on the Web site. Users also may not take any text out of context.
The Rainforest Alliance reserves the right to take such action as it deems appropriate in cases in which the Web site is inappropriately used to disseminate statements and/or materials that are reasonably construed as abusive, destructive, harmful or threatening to others.
Users may not by any means interfere with other individuals' use of the Web site. This includes, but is not limited to, sending a computer virus, worm, etc. or causing the Web site to become inaccessible.
The policy of the Rainforest Alliance is to protect the privacy of all individuals who call or send a letter, email, fax or instant message. However, the Rainforest Alliance reserves the right to reproduce and distribute by any means part or all of any telephone conversation, letter, email, fax or instant message without compensation to the caller or sender as long as no information that might reveal the identity of the caller or sender is included in the reproduction.
Legal Actions
These terms and conditions shall be governed by and construed in accordance with the laws of the state of New York. Individuals agree to submit to the personal jurisdiction of the courts of the state of New York.
In the event that any portion of these terms of use is deemed by a court to be invalid, the remaining provisions shall remain in full force and effect.
Individuals agree that regardless of any statute or law to the contrary, any claim or other legal action arising out of or related to use of the Web site must be filed within one year after the reason for the claim or other legal action arose. In addition, the claim or other legal action must be filed in a court located in New York County.
Changes to Terms of Use
The terms of use may be changed from time to time without prior notification.
